These General Conditions of Sales govern the sale of products (“Products” and / or “Product”) offered on the website quagliotti1933.it (“Website”).
The products marketed on the Website are offered and sold by Quagliotti S.p.A., VAT number: 05623970018, in Chieri (TO) – Strada Cambiano n. 58.

1. Scope of application of the General Conditions of Sale
   1 All orders placed through the Website are governed by these General Conditions of Sale, formulated in accordance with current legislation on distance contracts and electronic commerce. By submitting an order, you declare that you have read, understood and accepted these General Conditions of Sale.
   1.2 The purchase of Products through the Website is permitted only to subjects (“User” and / or “Users”) who have reached the age of 18 and who are consumers, meaning natural persons unrelated to any entrepreneurial and / or commercial and / or professional and / or craft activity.
   1.3 These General Conditions of Sale apply exclusively to Products delivered within the territory of the European Union.
   1.4 By consulting the Website, the User agrees to be subject to the conditions of use and the rules applied by Quagliotti S.p.A. on Internet confidentiality.
   1.5 Quagliotti S.p.A. reserves the right at any time to modify these General Conditions of Sale by publishing a new version on the Website. The applicable General Conditions of Sale are those in force at the time the order is placed.
2. Orders
   1 By sending an order through the Website, the User undertakes to purchase the Product he has ordered, in accordance with these General Conditions of Sale.
   2.2 Quagliotti S.p.A. reserves the right to refuse or cancel orders received in the following alternative cases:
   i) if the User has an ongoing legal dispute and / or has previously violated in any way the conditions and / or terms of a previous purchase order;
   ii) if the User is found to have been involved in fraud of any kind, in particular related to the use of credit cards and / or other payment systems;
   iii) if the User has released false and / or incomplete identification data;
   iv) if Quagliotti S.p.A. is aware of other elements that exclude or reduce the reliability and / or seriousness of the User.
   2.3 For the conclusion of the purchase contract for one or more Products, the User must proceed according to the instructions that will appear on the Website; the contract will be deemed confirmed when the User receives an email by Quagliotti S.p.A. containing the order confirmation.
   2.4 The data recorded by Quagliotti S.p.A. through the Website, they constitute proof of the order and the sales contract.
   2.5 In the event that the purchase price is not paid by the User or in any case the successful outcome of the payment is not confirmed, the purchase contract will be considered terminated by law pursuant to and for the purposes of art. 1456 of the Italian Civil Code.
   2.6 Quagliotti S.p.A. will proceed with the shipment of the Products only after receiving confirmation of the successful payment of the price by the User; the delivery terms will start from that date.
3. Availability and characteristics of the Products.
   1 The availability of Products is continuously monitored and updated; however, since the Website is visited by multiple users, even simultaneously, it may happen that one or more Products are temporarily unavailable.
   3.2 If the Product is not available, Quagliotti S.p.A. will notify the User by e-mail; in this case, the User will have the right to immediately terminate the contract and Quagliotti S.p.A. will return all sums received to the User.
   Alternatively, the User can opt for the following solutions:
   i) if it is possible to restock the Product, confirm the willingness to purchase the same in compliance with the new delivery terms communicated by Quagliotti S.p.A .;
   ii) if it is not possible to restock the Product, communicate the willingness to purchase a different Product, subject to adjustment to the User’s debit or credit based on the value of the replacement Product.
   3.3 The images and photographic representations of the Products on the Website faithfully reproduce the original Products. However, variations are always possible due to the technical characteristics of the device used by the User. The images and colors may not faithfully correspond to the real ones due to the Internet browser and / or the monitor and / or device used by the User. For such hypotheses, Quaqliotti S.p.A. will not be responsible in any way
4. “Custom Made” products
   1 Through the Website, the User is offered some possible forms of customizing (by way of example: insertion of digits and / or initials on the Product; customized combination of colors) of some Products (“Custom Made Products”).
   4.2 In relation to each Custom Made Product, Quagliotti S.p.A. will notify the User of the differse delivery times.
   4.3 In relation to Custom Made Products, the right to cancel for the User is not permitted.
5. Prices, shipping costs and payment methods
   1 All prices of Products published on the Website are expressed in Euros and include VAT.
   5.2 Shipping costs within the Italian territory and the European Community will be borne by Quagliotti S.p.A. and included in the prices.
   5.3 Payment can only be made by credit card.
6. Delivery
   1 All orders confirmed by Quagliotti S.p.A. will be delivered to the shipping address specified by the User at the time of order transmission.
   6.2 Deliveries can be made exclusively on the Italian national territory and on territories of European Union countries.
   6.3 For any requests for sales and deliveries to be made outside the territory of the European Union, in relation to which Quagliotti S.p.A. does not make any prior commitment, the User may send a specific non-binding e-mail to boutique@quagliotti.it
   6.4 The delivery times displayed on the Website and in the order confirmation, equal to four (4) weeks from receipt of payment, are to be considered indicative; Quagliotti S.p.A. will not be responsible for minor delays.
   6.5 The delivery obligation is fulfilled by transferring the material availability or in any case the control of the Products to the User.
   6.6 It is the User’s responsibility to check the conditions of the Products that have been delivered to him; it being understood that the risk of loss or damage to the Products, for reasons not attributable to Quagliotti SpA, is transferred to the User when the latter, even through a designated person, physically comes into possession of the Products, it is recommended that the User verify the integrity of the packaging and the number of Products received and, where possible, is invited to indicate any anomalies on the carrier’s transportation document.
7. Right to Return Items
   1 With the exception of Custom Made Products referred to in Article 4 above, the User, as a consumer, has the right to return items by written communication to withdraw the contract – this is to be sent preferably by e-mail to boutique@quagliotti.it, within fourteen (14) calendar days from when he, she or a designated third party received the Products.
   7.2 Following the procedure of the Right to Return, the User must return the Products to Quagliotti S.p.A., without undue delay and in any case no later than fourteen (14) calendar days from the notice of withdrawal.
   7.3 The costs and charges for returning the Products to Quagliotti S.p.A. are fully borne by the User, who assumes full responsibility.
   7.4 The Products must be returned to Quagliotti S.p.A. at the registered office in Chieri (TO) – 10023 – Strada Cambiano n. 58.
   7.5 By reason of withdrawal and upon receipt of the Products being returned by the User, Quagliotti S.p.A. will refund all payments received from the User, without undue delay and in any case no later than fourteen (14) days from the day on which it was informed of the withdrawal decision.
   7.6 The Products must be kept and inspected with normal diligence, and returned intact, complete in all their parts, fully functional for their purpose, accompanied by all accessories and leaflets, with identification tags and labels, where present, attached to the Products themselves, intact and not tampered with, perfectly suitable for their intended use, with no signs of wear or dirt. The Products must also be returned in their original packaging.
   7.7 The return applies to the Product in its entirety; it cannot therefore be exercised in relation to parts and / or accessories of the Product itself.
   7.8 In the event that the return has been done in accordance with the above provisions and more generally with the applicable legislation, it will not result in the termination of the contract and, consequently, will not give the right to any refund. Quagliotti S.p.A. will notify the User within 5 working days of receipt of the Product, rejecting the request for return. The Product, if already received by Quagliotti S.p.A., will remain with the latter available to the User for collection, which must take place at the expense and under the responsibility of the User.
8. Applicable law and competent court
   1 These General Conditions of Sale are governed by Italian law.
   8.2 The competent court is that of the User’s place of residence or domicile.
